The First Guardian super fund's failure in April 2025 left thousands of Australians facing substantial losses in their retirement savings. Investigations revealed that Netwealth had included First Guardian as an investment option on its platform without adequately understanding the associated risks. This oversight exposed investors to significant financial vulnerabilities.

Under the terms of the agreement, Netwealth will reimburse clients the face value of their First Guardian investments by January 30. Additionally, the company has committed to enhancing its investment selection processes and has entered into a court-enforceable undertaking with the Australian Prudential Regulation Authority (APRA) to improve its procedures.

ASIC Deputy Chair Sarah Court highlighted the importance of this settlement, stating that it ensures affected members are restored to their original financial positions without the need to await the outcomes of ongoing investigations or legal proceedings. She emphasised that superannuation trustees must diligently monitor the funds they offer to members, reinforcing the critical role of due diligence in protecting investor interests.

Netwealth Chair Michael Wachtel expressed the company's commitment to promptly addressing the issue, noting that the agreement with ASIC was the most efficient way to compensate affected members. He also mentioned that Netwealth had withdrawn its application for government compensation, opting instead to directly fund the reimbursements.

This case serves as a cautionary tale for financial institutions about the importance of thorough risk assessment and due diligence when offering investment options. For investors, it underscores the necessity of staying informed about where and how their superannuation funds are allocated, ensuring that their retirement savings are managed prudently and securely.
