Clark Family Pty Ltd (“we”, “us”, “our”) operates Financial Services Online and associated websites as a digital marketing and lead referral platform.
We invite visitors (“consumers”) to make enquiries relating to financial and insurance products and services, which are then referred to appropriately licensed professionals.
We do not provide credit or financial advice, issue financial products, or act as an intermediary or broker.
All regulated activities are undertaken exclusively by licensed or authorised third-party professionals.
By registering as an adviser or broker and purchasing leads, you agree to be bound by these Terms and Conditions.
Visitors to our websites are attracted through various online and offline advertising channels managed by us.
When a visitor completes an enquiry form, the submitted data is securely collected, formatted, and distributed as a lead to one licensed broker or adviser.
Leads are allocated to brokers through a bidding system. As a participating broker, you may nominate:
The type of leads you wish to receive;
The geographical territory in which you wish to operate;
The maximum bid amount you are willing to pay per lead; and
An optional weekly spending limit.
By purchasing or receiving leads, you warrant that you:
Hold all relevant licences, authorisations, or accreditations required under the Corporations Act 2001, the National Consumer Credit Protection Act 2009 (NCCP), or other applicable laws;
Possess the necessary education, training, and experience to handle consumer enquiries responsibly;
Have, if applicable, the permission of your licensee to receive and purchase leads;
Will respond to consumer enquiries promptly and professionally, and in any case within the timeframes required by law or industry standards;
Will handle all personal information in accordance with the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth); and
Will use the lead information only for the purpose of contacting the enquirer in relation to their original enquiry.
You warrant on a continuing basis that your licence or authorisation remains current.
You must immediately notify us of any change, suspension, or cancellation of your licence or authorisation.
We reserve the right to suspend or terminate your participation if we believe you are not compliant with these requirements.
You acknowledge that visitors to the Financial Services Online network are seeking access to comparative information and competitive options in respect of credit and insurance products.
Accordingly, where practical and subject to your expertise, licensing limitations, and the consumer’s stated requirements, you agree to:
(a) Offer or discuss comparative rates, terms, and product options from more than one product provider, where multiple suitable options are available to you;
(b) Act in the best interests of the consumer, consistent with the expectations of the ASIC Act 2001, the NCCP Act 2009, and the Corporations Act 2001;
(c) Provide clear disclosure of your role, licence, and any associations or remuneration arrangements that could influence product recommendations; and
(d) Engage only with product providers that hold the appropriate Australian Credit Licence or Australian Financial Services Licence for the relevant product.
You must not represent yourself, or the Financial Services Online platform, in a manner that could mislead consumers regarding the range of products or independence of comparison services available.
Failure to adhere to these obligations may result in suspension or termination of your account, and may be referred to the relevant regulatory authority or licensee where appropriate.
Leads are distributed exclusively (never shared) to the highest eligible bidder who:
Holds sufficient funds in their prepaid account; and
Has not exceeded their self-imposed weekly spending limit.
Where multiple active bidders exist within a product and geographic category, the price charged for the lead will be calculated as half-way between the winning bid and the next highest bid, and will never exceed your nominated maximum bid.
All account activity, including bids, adjustments, and allocations, is logged and may be audited for compliance.
You may opt to enable Dynamic Bidding, which allows your maximum bids to increase or decrease automatically by up to ±20% based on the following parameters:

Dynamic Bidding may cause you to exceed your nominated maximum bid amount.
To purchase leads, you must prepay your account by credit card, electronic funds transfer, or PayPal.
Funds in your account represent prepayments for future lead purchases and do not constitute a deposit, investment, or trust account.
No interest is payable on any account balance.
From your administration zone you can:
View and download lead and invoice records (available for 90 days);
Submit credit or refund requests (see Section 8);
Manage bids, budgets, and notifications; and
Update your business and contact information.
Consumers who make an enquiry expect contact within two (2) business days.
Failure to make reasonable contact may result in administrative action or complaint escalation.
If a complaint is received from an enquirer that has not been contacted, we may forward the complaint to you.
If no contact attempt has been made within two business days, we reserve the right to apply an administrative fee.
Complaints relating to regulated advice or credit assistance will be referred to the responsible licensee or adviser. Clark Family Pty Ltd does not provide regulated advice and cannot resolve such complaints directly.
While we take reasonable steps to ensure that all leads are genuine, the accuracy of consumer-supplied information is outside our control.
Accordingly, we make no warranty as to the accuracy or completeness of any lead information, to the extent permitted by law.
You may request a refund or credit where:
Both the telephone and email contact details are invalid; or
A duplicate enquiry from the same applicant is received within 90 days.
A telephone number is deemed invalid if it is not connected or does not belong to the enquirer.
An email is invalid only if delivery attempts return a permanent “bounce” error.
Credit requests must be made within 14 days of the enquiry date through your administration zone.
Requests are manually reviewed at least weekly, and you will be notified of approval or rejection by email.
Rejected credit requests that do not meet criteria may attract an administrative fee.
You are not authorised to submit enquiry forms on our websites for testing or demonstration purposes.
Such submissions generate live leads that may be allocated to other advisers.
We reserve the right to apply administrative fees or suspend accounts in the event of unauthorised form submissions.
Prepaid funds are intended for purchasing leads only.
Refunds of unused balances are not ordinarily provided except where:
We permanently withdraw all lead types for which you are actively bidding; or
Exceptional circumstances apply, at our discretion.
No refund or withdrawal will be made for any sign-up or promotional bonus credited to your account.
You agree to comply with all applicable laws, including but not limited to the:

Corporations Act 2001
National Consumer Credit Protection Act 2009
Privacy Act 1988 (Cth)
You acknowledge that Clark Family Pty Ltd is not licensed under the above legislation and that you are solely responsible for ensuring your conduct with consumers is compliant with your licensing obligations.
We may suspend or terminate your access to the system if:
You breach these Terms or any law;
You fail to maintain required licensing;
You misuse lead data or submit forms improperly; or
We believe your conduct could harm consumers or the integrity of the Financial Services Online platform.
To the extent permitted by law, we disclaim all representations or warranties regarding the accuracy, completeness, or suitability of lead information or website content.
Our total liability for any claim arising under these Terms will not exceed the amount paid by you for the specific lead in question.
We handle all data in accordance with our Privacy Policy and the Australian Privacy Principles (APPs).
We implement technical and administrative safeguards to protect personal information against unauthorised access, alteration, or disclosure.
You must do the same for all consumer data received from us.
These Terms and Conditions are governed by the laws of Queensland, Australia, and each party submits to the exclusive jurisdiction of the courts of that state.
All enquiries or support requests should be lodged via our online support ticket system.
Before submitting a ticket, please review the FAQ and knowledge base.
We do not provide telephone or direct email support for routine matters.
Financial Services Online provides a transparent, compliant, and auditable lead referral platform connecting consumers with licensed finance and insurance professionals.
By purchasing or receiving leads, you confirm that you are properly licensed, compliant with all applicable laws, and bound by these Terms and Conditions.
